One of the most common questions I receive is: “Can foreigners own property in Mexico?” The answer is yes. For properties located within Mexico's restricted zone—including Rosarito, Baja California—foreign buyers typically acquire ownership through a Fideicomiso, or bank trust.

What Is a Fideicomiso?

A Fideicomiso is a legal trust established through an authorized Mexican bank. The bank holds legal title on behalf of the foreign buyer, who is the beneficiary of the trust.

As the beneficiary, you have the right to use, occupy, remodel, rent, sell, or transfer the property to your heirs.

Your Rights as the Beneficiary

- Live in the property full-time or seasonally.
- Sell the property at any time.
- Lease the property (subject to applicable laws and HOA rules).
- Remodel or improve the property.
- Name and update beneficiaries who can inherit the property without probate in many cases.

Why Does It Exist?

Mexico's Constitution restricts direct foreign ownership of residential property within approximately 50 kilometers (31 miles) of the coastline and 100 kilometers (62 miles) of international borders. The Fideicomiso was created to allow foreign buyers to safely acquire and enjoy property in these areas while complying with Mexican law.

How Long Does the Trust Last?

The trust is typically established for 50 years and may be renewed for additional 50-year periods, allowing families to enjoy long-term ownership across generations.

Who Is Involved?

You: The beneficiary with the rights of ownership.
The Bank: Holds legal title in trust as required by law.
The Notary Public: Oversees and formalizes the transaction.
The Escrow Company: Helps facilitate a secure closing when escrow is used.

Myth: The bank owns my property.
Fact: The bank acts only as trustee. You retain the beneficial rights to the property.

Myth: I can lose my property if the bank closes.
Fact: The trust can be transferred to another authorized bank if necessary.
